These Terms govern your relationship with Start Bigger LLC ("Tokanza", "we") when you create and use a digital store on our platform. By creating an account, paying, or using the service you agree to these Terms, the Privacy Policy, the Billing Policy and the Acceptable Use Policy.
1. The service
Tokanza is a software-as-a-service platform that lets you launch an Arabic-first online store for digital products (game top-ups, coins, digital cards, subscriptions and similar) on a subdomain or a custom domain, with an admin panel, templates, tracking tools and reports. Available features depend on your plan.
2. Account and eligibility
- You must be at least 18 (or the age of majority where you live) and able to enter into a binding contract for yourself or your business.
- You are responsible for the accuracy of your registration data, for keeping your password confidential, and for all activity under your account. Tell us immediately if you suspect unauthorised access.
- We may refuse registration or terminate an account for misleading information or breach of these Terms.
3. Plans, subscription and billing
- Setup fee: a one-time fee paid up front when your store is created, covering initial setup and provisioning. It is shown before you pay.
- Recurring subscription: a monthly or yearly subscription collected in advance through Stripe. It renews automatically at the end of each cycle until you cancel.
- There is no free trial unless one is expressly offered at checkout.
- The prices shown on the pricing page and at checkout apply. Taxes (such as VAT) may be added depending on your country.
- Billing cycles, amounts due, failed payments and price changes are covered in the Billing Policy; cancellation and refunds in the Cancellation and Refund Policy.
4. Acceptable use
Your use is subject to the Acceptable Use Policy. You may not sell or promote illegal, stolen or provider-prohibited goods or services, or use the platform for fraud, malware, or to infringe the rights of others.
5. Your responsibility for your store
- You alone are responsible for your store: its products, prices, descriptions, content, images, customers, customer support, order delivery, refunds, taxes, licences and compliance with local law and consumer-protection rules.
- Tokanza is not a party to transactions between you and your customers, does not sell your products, and does not guarantee their quality or legality.
- Tokanza is not a payment processor for your store. Money you receive from your customers is handled through the payment methods you choose and contract for yourself, and you bear responsibility for disputes, refunds and chargebacks.
- You are the controller of your store customers' data and we act as processor under the Data Processing Addendum. You must publish a privacy policy and terms suitable for your business in your store.
6. Intellectual property
The platform, its logo, software and templates remain ours or our licensors'. We grant you a limited, non-exclusive, non-transferable licence to use them for the duration of your subscription. You keep ownership of your content (text, images, products) and grant us a limited licence to host, display and back it up as needed to provide the service. You warrant that you have the right to use what you upload.
7. Availability and disclaimer
We make reasonable efforts to keep the service available, but it is provided "as is" and "as available", without warranty of uninterrupted or error-free operation. Maintenance, faults or third-party outages may occur. We do not commit to a specific service-level agreement (SLA) unless agreed separately in writing.
8. Data and backups
We keep periodic backups for disaster recovery; they are not a substitute for your own copies. You may request an export of your data during your subscription. After termination we keep data for a limited period and then delete it in line with the Privacy Policy and the Data Processing Addendum.
9. Suspension and termination
- You may cancel at any time from the admin panel; cancellation stops the next renewal and your store stays active until the end of the paid period.
- We may suspend or terminate a store immediately for breach of these Terms or the Acceptable Use Policy, for fraud or excessive disputes, or for non-payment after the grace period.
- On termination the public storefront stops, and the clauses intended to survive (ownership, liability limits, governing law) continue to apply.
10. Limitation of liability
To the maximum extent permitted by law we are not liable for indirect or consequential damages, lost profits, loss of data or reputation. Our total liability to you is limited to the amounts you paid us in the twelve months before the event giving rise to the claim. Nothing here excludes liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify and hold us harmless from claims and losses arising from your products, content, dealings with your customers, or your breach of these Terms or the law.
12. Changes
We may update these Terms. We will notify you of material changes by email or in the admin panel a reasonable time before they take effect; continued use after that date means acceptance. The current version and its effective date appear at the top of this page.
13. Governing law
These Terms are governed by the laws of the State of New Mexico, USA, and its courts have jurisdiction over any dispute, without prejudice to any mandatory consumer rights in your country of residence.
